1. Introduction and Acceptance
These Terms of Service (“Terms”) govern your access to and use of the website located at amplifysupps.com and all related content, features, and services (collectively, the “Site”), operated by Amplify Distribution LLC, doing business as Amplify Supps (“Amplify Supps,” “we,” “us,” or “our”).
By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, Refund & Returns Policy, and Shipping Policy, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Site or place an order.
2. Eligibility
You must be at least 18 years of age and able to form a legally binding contract to use the Site or purchase our products. By using the Site, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
3. Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate any account at our discretion, including for violation of these Terms.
4. Products and Dietary Supplement Disclaimer
Our products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.
All information provided on the Site is for general informational purposes only and is not intended as, and should not be relied upon as, medical advice. Consult your physician or a qualified healthcare provider before using any product, particularly if you are pregnant, nursing, taking medication, or have a medical condition. Individual results may vary.
5. Product Descriptions, Pricing, and Availability
We strive to describe and price our products accurately, but we do not warrant that product descriptions, pricing, or other Site content is accurate, complete, current, or error-free. We reserve the right to correct any errors, change prices, and modify or discontinue products at any time without prior notice. All prices are listed in U.S. dollars and are exclusive of any applicable taxes unless stated otherwise.
6. Orders; Acceptance and Cancellation
Your submission of an order constitutes an offer to purchase. All orders are subject to our acceptance. We may, in our sole discretion, accept or decline any order, limit or cancel quantities, or cancel an order (including after a confirmation has been sent) for reasons including suspected fraud, errors in pricing or product information, or product unavailability. If we cancel an order after payment has been processed, we will issue a refund to your original payment method.
7. Payment
You represent and warrant that you are authorized to use the payment method you provide. Payments are handled by third-party payment processors (including Shopify Payments and other providers), and your use of those services is subject to their respective terms and privacy policies. You authorize us to charge your payment method for the total amount of your order, including any applicable taxes and fees.
8. Shipping and Delivery
We currently ship within the United States only. Shipping and delivery timeframes are described in our Shipping Policy. Title and risk of loss for products pass to you upon our delivery of the products to the carrier.
9. Returns and Refunds
Returns, refunds, and our satisfaction guarantee are governed by our Refund & Returns Policy, which is incorporated into these Terms by reference.
10. Intellectual Property
All content on the Site — including text, graphics, logos, images, product descriptions, and the “Amplify Supps” name and marks — is owned by or licensed to us and is protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.
11. Acceptable Use
You agree not to use the Site to: (a) violate any applicable law or regulation; (b) interfere with or disrupt the Site or its servers; (c) attempt to gain unauthorized access to any portion of the Site or related systems; (d) introduce viruses or other malicious code; (e) scrape, harvest, or collect data from the Site by automated means; or (f) infringe the rights of any third party.

You are solely responsible for the content you submit and represent that it does not violate any law or the rights of any third party. We reserve the right to remove any content at our discretion.

The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party site, and your use of them is at your own risk.
14. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AMPLIFY SUPPS AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify, defend, and hold harmless Amplify Supps and its affiliates, officers, members, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
17. Governing Law
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles.
18. Dispute Resolution; Arbitration; Class Action Waiver
Informal Resolution. Before filing any claim, you agree to first contact us at admin@amplifydistro.com and attempt in good faith to resolve the dispute informally.
Binding Arbitration. If a dispute cannot be resolved informally, it will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration seated in Maricopa County, Arizona. The Federal Arbitration Act governs the interpretation and enforcement of this provision.
Class Action Waiver. You and Amplify Supps agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect its intellectual property rights.
19. Changes to These Terms
We may update these Terms from time to time. Any changes become effective when we post the revised Terms and update the “Last updated” date above. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
20. Severability; Entire Agreement; Waiver
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of that provision.
